Studio Terms of Service
Terms of service for Pierce of Cake Studio.
For the safety and health of clients and staff, and in order to continuously improve the quality of the services provided, please read the following Terms of Service before using our services.
1. These Terms of Service, hereinafter referred to as the "Terms," set out the detailed rules for using the services provided at Pierce of Cake, located at ul. Śrutowa 14/LU1, 50-256 Wrocław, hereinafter referred to as the "Service Provider."
2. The Service Provider provides Services on selected days and at selected hours.
3. Clients of the Service Provider are required to read the Terms before booking an appointment for services at Pierce of Cake. Proceeding with a chosen service constitutes acceptance of these Terms, without the need for the Client to sign them.
4. The Terms, together with the Price List and service descriptions, constitute the service agreement.
1. Client – means a natural person who is of legal age (has turned 18) and has full legal capacity.
2. Minor – a client who has not turned 18 and uses the services with the written consent of a parent/legal guardian. The consent form available at the studio must be signed.
3. Terms – means these Terms drawn up by the Service Provider.
4. Service Provider – means the Service Provider providing services at the given premises at ul. Śrutowa 14/LU1 and ul. Śrutowa 17/1, 50-256 Wrocław.
5. Service – means a service/treatment provided by the Service Provider to the Client.
6. Deposit – a form of security for a booked appointment, paid in advance before the service is performed, deducted from the final price after the service is completed. In the case of bookings made via the Booksy app, the deposit will be charged to the Client's account if the Client cancels the appointment less than 48 hours before the scheduled visit, does not show up, arrives late enough that the service can no longer be performed, or in other cases described further in these Terms.

§ 3 Important Information Before a Piercing Appointment
• Please arrive at the studio clean and well-rested.
• Proper hydration is very important.
• Avoid alcohol and drugs for 48 hours before the piercing.
• Eat a light, nutritious meal on the day of the appointment.
• For piercings located in the oral cavity, be prepared for a temporary change in diet and to stop smoking during healing.
• Reschedule your appointment if your body is weakened following a recent illness or while undergoing antibiotic treatment — a minimum wait of 2 weeks after completing the treatment is recommended.
• Pregnancy and breastfeeding are contraindications for piercing.
• Cold sores (herpes) are a contraindication for piercing, as they indicate the body is weakened.
• Inform the piercer of all illnesses and medications you are taking (remember especially medications affecting blood density and clotting, and those weakening the immune system) — this allows the piercer to assess whether the procedure is safe.
• After consulting your doctor, on the day of the piercing you should discontinue all blood-thinning or anticoagulant medications.*
*These include, among others:
• non-steroidal anti-inflammatory drugs: paracetamol, ibuprofen, salicylic acid derivatives (ACC, aspirin, Polopiryna), phenylacetic acid derivatives (diclofenac)
• medications used for phlebitis, e.g., heparin
• certain antidepressants, e.g., MAO inhibitors
• medications used for systemic lupus erythematosus
• If you suffer from chronic conditions (e.g., autoimmune, allergic, or viral in origin), consult your treating physician before the piercing, who will assess its safety — in the case of a flare-up of conditions such as multiple sclerosis or Crohn's disease, reschedule the appointment.
• If you are HIV-positive, before the piercing make sure your current CD4 and CD8 lymphocyte levels allow you to undergo the body piercing procedure.
• Inform your piercer of any surgeries, transplants, blood transfusions, or vaccinations you have had in the past year.
• For 3 hours before the piercing, avoid coffee, cola, energy drinks, strong tea, large amounts of ginger, garlic, cranberry juice, high doses of vitamin C, and turmeric.
• Do not use any anesthetics before the piercing (including those administered by a doctor) without consulting the piercer first.
• Piercings are not recommended during menstruation; piercings may (though not always) be more painful at that time.
• If you plan to visit the dentist in the coming months or have untreated cavities, postpone any oral piercing until later.
• If you are considering a nipple piercing, make sure you have up-to-date breast screening results and check whether any close family members have had breast cancer — if there is such a family risk, women's screening results should be no older than six months.
• If you have breast implants, inform your piercer, and consult your surgeon regarding the decision to get a nipple piercing.
• If you have an upcoming procedure, surgery, CT scan, or X-ray in the near future, postpone the piercing.
• Choose comfortable, non-restrictive, breathable clothing for the appointment, depending on the piercing location.
Healing Time
Piercings take about 6 months or longer to heal, depending on the type. The piercer will provide the exact healing time at the appointment, so plan your piercing date accordingly.
Piercings and Vacations
Fresh piercings must not be soaked in the sea, lakes, or swimming pools. These contain many bacteria that can enter an open wound. It is better to plan your appointment after returning from your trip. Winter sports are also a contraindication due to helmets, which may press on and irritate the piercing site.
Piercings and Sports
Sport is not a strict contraindication; it is an individual matter. If the client feels well, they may return to physical activity, but should be careful not to irritate or strain the tissue where the piercing is located.
Piercings and Alcohol
It is recommended to abstain from alcohol throughout the entire healing process — several months, with the exact duration provided by the piercer at the appointment, depending on the type of piercing. Alcohol thins the blood and can cause increased swelling.
Tendency to Faint
If the client has a tendency to faint or other conditions requiring a longer scheduled appointment, please inform us of this when booking.
Illness
Do not come to your appointment while ill; the piercing will not be performed. The body must be fully healthy in order to heal a new piercing. After an illness, wait a minimum of 2 weeks.
Antibiotics
Do not come to your appointment while undergoing antibiotic treatment; the piercing will not be performed. Wait a minimum of 2 weeks after the last dose. For isotretinoin (Accutane), wait 6 months after the last dose.
Vaccination
We do not recommend booking an appointment if the client has a vaccination scheduled around that time. After vaccination the body may be weakened, which could affect the piercing. It is best to get vaccinated first and wait at least 2 weeks.
Blood Donation
After getting a piercing, do not donate blood for a period of 6 months. Any procedure that breaches the skin carries a risk of infection, so a 6-month period is considered safe to confirm the absence of any potential illness.
If the client has donated blood, they may book a piercing appointment after 4 weeks, to allow the body to recover before another procedure that breaches the skin.
Cold Sores (Herpes)
Cold sores on the body indicate that the immune system is weakened. This may suggest an oncoming cold, so the appointment should be rescheduled and the piercing will not be performed.
Healing Piercings
The piercer may refuse to perform the service due to other piercings that are still healing. This may place too much strain on the body — especially if there are complications related to those piercings. If the client is unsure, they can always contact the studio or their piercer beforehand to discuss the situation individually.
Planned Procedures
If the client is planning or has recently undergone procedures or surgery, the piercer may refuse to perform the piercing due to excessive strain on the body. Health status should be discussed with the treating physician, or the studio should be contacted before the appointment.
Appointment Duration
An appointment lasts 30 minutes. For multiple piercings, it will take longer. A maximum of 3-4 piercings can be performed per appointment, depending on placement and the client's health condition. If during the appointment the client wants to change jewelry or have a consultation, this should be reported in advance so that additional time can be reserved.
Please arrive 10 minutes before the scheduled appointment time to sign the consent form and prepare for the procedure.
Jewelry Warranty
If an earring/stud falls out of the piercing:
• Within the first 2 days of insertion — a new, identical piece of jewelry will be provided or 100% of the cost of the flat-back/disc will be refunded.
• Within 3–7 days of insertion — 50% refund of the value of the flat-back/disc.
• After 7 days of insertion — non-refundable.
The manufacturer of the premium jewelry provides a lifetime warranty against manufacturing defects; shipping costs are borne by the client, and each case will be considered individually.
Age Thresholds
• Earlobes – 10 years
• Cartilage – 13 years
• Industrial – 16 years
• Vertical tragus – 16 years
• Snug – 16 years
• Face – 16 years
• Navel – 16 years
• Intimate, nipple, microdermal – 18 years
Age thresholds are set by the studio; we do not perform piercings below the set age even with the consent of a parent or legal guardian. The child must have reached, for example, their 16th birthday according to their actual date of birth, not merely the calendar year.
Parental Consent
The parent or legal guardian must appear in person at the appointment to sign the consent form available at the studio. It is possible to sign the consent form in advance — the parent or guardian signs the consent, which is kept at the studio until the scheduled appointment. After signing, the minor may attend alone or with another adult. Consent forms are valid for 30 days from the date of signing. We do not accept handwritten statements from parents, and we do not send our consent forms by email, mail, or through another person. Consent given by phone or email is not sufficient to perform the piercing.
Consultations
Consultations are free of charge only for studio clients. The client bears the cost of new sterile jewelry if it needs to be inserted, as determined by the piercer. Sterile jewelry prices start at PLN 30.
If a client fails to show up for a consultation appointment without prior notice, every subsequent consultation will cost PLN 50 plus any applicable jewelry cost.
If a client does not follow the recommendations discussed at the appointment and the aftercare instructions provided, the consultation will cost PLN 50 plus any applicable jewelry cost.
We do not provide consultations, jewelry changes, or downsizing services for people who did not get their piercing done at our studio — even for a fee.
Downsizing
Jewelry downsizing takes place a minimum of 5 weeks after the piercing was performed. The piercer will determine the exact timing at the appointment. The cost is PLN 30 per piece for a new, shorter, sterile labret stud. The piercer will explain in detail which piercing needs downsizing and when. Clients may not bring their own jewelry for downsizing — the piercer selects and inserts the new jewelry.
Jewelry Change
The first jewelry-change service is free; each subsequent one costs PLN 30 — any number of pieces of jewelry may be changed, but the exact quantity must be reported in advance so that adequate time can be reserved. A client booked for a jewelry-change service must bring the jewelry they have already purchased. Otherwise, the jewelry-change service will not take place.
Changing to Bioplast
A client may change their jewelry to bioplast (e.g., for a medical exam or hospital visit, etc.); the cost of such a visit is PLN 30 plus the cost of the jewelry. This service is also available only to studio clients. If the piercing is fresh and still healing, this must be reported when booking — the piercer must prepare sterile bioplast jewelry in advance. If the piercing is fully healed, the client must purchase the bioplast jewelry themselves — this can be done at our shop across from the studio.
Anesthesia
We do not use anesthetics.
Aftercare
Every client is thoroughly briefed on how to care for a fresh piercing during the appointment, and also receives a leaflet with all the information regarding aftercare, jewelry type, and contact details for the piercer who performed the piercing.
Jewelry Provided by the Studio
Jewelry inserted into a fresh piercing must be sterile and made of appropriate, safe materials (titanium or gold); the piercer must select a jewelry size suited to the client's anatomy. We do not insert jewelry brought in by the client.

Booking Appointments
Phone: 731 221 646, [email protected], Facebook/pierceofcake, Booksy/pierceofcake. We do not take bookings via Instagram. Consultations cannot be booked via Booksy.
We have designated hours for consultations, jewelry changes, and downsizing. Piercings take place during other hours.
Opening Hours
Monday – Friday: 10:00 AM – 6:00 PM.
Accompanying Persons
Accompanying persons may wait in the waiting room if space is available. Accompanying persons are not allowed into the treatment room, unless otherwise arranged with the piercer. Children who are accompanying persons are not allowed into the treatment room; they may wait in the waiting room with another adult.
1. A Client of the Service Provider is a person of legal age, or a minor with the consent of a parent/legal guardian. In the case of a minor, the Service Provider is entitled to review the relevant guardian's consent before the appointment and to refuse to provide the Service if such consent is lacking.
2. The Client is required to disclose information about their health condition, where necessary to decide on performing a given service, and to sign a declaration confirming the truthfulness of the information provided, by completing and signing the required documentation.
3. Every Client is made aware of the indications, contraindications, side effects, and post-procedure recommendations, and by proceeding with the Procedure confirms full awareness and acceptance of them. This is confirmed by the client's signed informed consent to the procedure.
4. Each time a Procedure is performed again, the Client should confirm the current status of their health and previously provided information, or update medical information each time, particularly regarding contraindications.
5. The Client is required to immediately notify the person performing the procedure of any deterioration in their health condition during the Service.
6. Clients should attend their scheduled appointment without accompanying persons.
7. The Client should arrive 10 minutes before the start of the Service.
8. The Client should inform the Service Provider of any potential lateness by phone, email, or text message with reasonable advance notice.
9. The Service Provider allows a maximum lateness of 10 minutes (counted from the start of the scheduled appointment), after which the service will be canceled or shortened. Each case of lateness is considered individually by the Service Provider.
10. In case of frequent cancellations by the Client later than permitted under these Terms, or failure to show up for a scheduled appointment without canceling within the specified timeframe, 3 times or more, the Service Provider is entitled to refuse to provide services or book further appointments for that Client.
1. The Service Provider provides the services listed in the current price list available at the Service Provider's reception, in the Booksy booking system, and on the official website.
2. Before selecting a Service, the Client may review its description, duration, and price.
1. The Service Provider handles appointment bookings via: reception, the Booksy booking system, email, phone, and Facebook.
2. The Client receives a reminder text message from the Service Provider 24 hours before the appointment.
§ 7 Information About the Booking Deposit
1. The deposit is held by the Booksy booking system.
2. The deposit is paid in person at the studio at the time of booking, amounting to 50% of the price of the planned procedure, by card or cash.
The Deposit Is Forfeited:
• in case of cancellation of the appointment too late (later than 48 hours before the scheduled date)
• in case of not showing up at the studio
• in case of lateness that makes it impossible to carry out the appointment
• in case of illness, cold, or cold sores
• in case the client is taking antibiotics
• in case the client has recently undergone or is planning to undergo a procedure or surgery in the near future
• in case of pregnancy and breastfeeding
• in case of the absence of a parent or legal guardian to sign consent for the piercing (another adult who is not the parent or guardian cannot sign the consent)
• in case the client is planning a vacation, trip, or other activities in the near future that could negatively affect safety and healing
• in case the client is under the influence of alcohol or other substances
3. Please carefully consider and plan the timing of your appointment. If the Client is unsure whether they are able to get a piercing, they can always contact the studio or a doctor.
4. If a Client fails to show up for an appointment once, every subsequent booking must be made through the Booksy app.
5. In the event of cancellation or rescheduling of the appointment by the Client later than 48 hours before the service, failure to show up without cancellation, or lateness that makes it impossible to perform the service, and other cases listed above, the Deposit will be non-refundable.
6. In the event that the client's anatomy does not allow for the piercing to be performed, no deposit will be charged; the client may choose another piercing after discussing it with the piercer, or withdraw entirely.
7. In accordance with the act on concluding distance contracts and contracts outside a business premises, a Client who books an appointment by phone, email, the Booksy booking system, or a Facebook message (i.e., remotely/at a distance) has the right, after paying the Deposit, to withdraw from the agreement and cancel the booked service up to 48 hours before the scheduled appointment. A Client choosing to withdraw from a distance contract should notify the Service Provider in writing at the email address: [email protected], by phone at 721 331 646, or via a Facebook message, citing the right of withdrawal from a distance contract and providing bank transfer details for the refund. After a valid withdrawal from the contract, the Deposit will be refunded in full to the Client within 14 calendar days of the Service Provider receiving notice of the withdrawal. The Deposit will be refunded via bank transfer to the details provided by the Client. If the client fails to notify the Service Provider of their withdrawal from the distance contract, the Deposit will be non-refundable.
8. A Client exercising the right of withdrawal from a distance contract acknowledges the deadline set out in point 5 of this section, which also falls within the possible period for canceling or rescheduling the service without losing the deposit.
9. A Client making a remote booking and paying the Deposit understands and agrees to the loss of the right to withdraw from the distance contract. In such case, cancellation of the service means the deposit paid will be non-refundable. Point 8 of this section is included within the possible period for withdrawal from a distance contract and the possibility of canceling/rescheduling the booked appointment.
10. In case the Service Provider cancels the Service, or changes the appointment date to one that does not suit the Client, the Deposit will be refunded in full by bank transfer to the details provided by the client, within 14 calendar days.
11. Upon completion of the Service, the Deposit is credited toward the price of the Service performed for the Client. The final price settled after the Service is completed will be reduced by the amount of the paid Deposit.
12. For the purposes of these Terms, "Force Majeure" means any event beyond the Service Provider's control, including, among others, an accident, epidemic and pandemic, war, uprising, riots, unrest, acts of terrorism, fire, explosion, flood, theft, or failure of essential equipment, intentional damage affecting the Service Provider's operations, strike, lockdown, weather conditions, acts and regulations of state or local government authorities, and sudden utility outages at the Service Provider's premises. The Service Provider will not be liable to the Client for failing to fulfill any obligations arising under these Terms to the extent this is caused by the occurrence of Force Majeure. In such a situation, the Client will be given the choice of: booking another available appointment date, receiving a refund of the paid Deposit, or receiving a voucher for the amount of the paid Deposit, to be used in accordance with the agreed expiration date.
1. The Client is required to pay for the Services rendered immediately after they are performed.
2. The Service Provider offers the following payment methods: cash, card, BLIK.
3. The Service Provider reserves the right to introduce temporary promotions, gift vouchers, or service packages.
4. Promotions cannot be combined.
§ 9 Hygiene and Safety – Service Provider Standards
1. The Service Provider declares that all employees are properly trained and experienced, hold up-to-date health certificates, and perform Services to the highest standard and with due diligence.
2. Before performing a Service, the employee is required to properly prepare their workstation and ensure adequate disinfection is carried out before each Client.
3. The employee is required to perform the procedure correctly, in accordance with applicable procedures and professional standards, while maintaining appropriate hygiene and sanitary conditions and occupational health and safety and fire safety regulations.
4. Only disinfection products approved for use and required by the sanitary inspectorate, in accordance with applicable regulations and standards, are used when performing procedures.
5. In caring for the hygiene and safety of clients, the Service Provider, with the utmost diligence and adherence to hygiene and sanitary procedures, uses appropriate certified disinfection products, sterilization equipment (autoclave), and single-use tools.
6. In the event of a client being injured during the Procedure, the Procedure is immediately stopped, a post-exposure procedure is initiated, and the injury site is promptly cleaned, disinfected, and covered with a sterile dressing appropriate to the extent of the injury. The interrupted Procedure is completed, if possible, once the injury site has been secured, or at another time convenient for the client.
§ 10 Service Provider Obligations
1. Before performing a Service, the Service Provider is required to: conduct an interview with the Client regarding their expectations and health condition, and obtain from the Client a completed and signed consent to the procedure; present the Client with any contraindications to the Service and any post-Service recommendations; inform the Client of the realistic effects of the procedure, any possible side effects or complications following the procedure, and the products used in the procedure; comply with hygiene and safety rules while performing Services, in accordance with sanitary procedures, treatment procedures, and occupational health and safety regulations.
2. The Service Provider reserves the right to make changes to the Terms for important reasons, i.e., such as: changes in the law, changes in payment methods, or changes in the provision of services — to the extent that these changes affect the implementation of these Terms. The new Terms take effect on the date the changes are introduced.
3. In case of doubts regarding the safety of performing a procedure, the Service Provider reserves the right to refuse to perform it.
§ 11 Terms and Conditions for Purchasing and Redeeming Vouchers
1. Definitions:
• Voucher (gift voucher) – a voucher for a specific service, package of services, or a specific amount, purchased by a Client of the Service Provider, hereinafter referred to as the Purchaser, for a third party, hereinafter referred to as the Recipient.
• Service Provider – Pierce of Cake Magdalena Młodzianko, ul. Śrutowa 17/1, 50-256 Wrocław, Tax ID (NIP): 8951856472.
• Recipient – the person redeeming the Voucher.
• Purchaser – the person purchasing the Voucher.
2. Vouchers entitle the holder to use services in accordance with the current price list.
3. The Recipient is required to book a suitable appointment date in advance.
4. The Voucher must be presented after the service has been performed. After the service is completed, the Voucher remains at the studio.
5. The Voucher should be redeemed within 6 months of its purchase. In exceptional situations, the validity of the Voucher may be extended. Each such situation will be considered individually by the Service Provider.
6. The Voucher cannot be exchanged for cash. In exceptional situations, personalized Vouchers may be used by a person other than the one named on the Voucher.
7. Vouchers are non-refundable. This does not apply to vouchers purchased online.
8. If the value of the service selected by the Recipient exceeds the value of the voucher, the Recipient is obliged to pay the difference.
9. A Voucher may be redeemed during one or multiple appointments.
10. In case of a change to the service price list after a Voucher is purchased, a Voucher for a specific service or package of services will be honored according to the price list in effect on the date the Voucher was purchased.
11. Any complaints related to the redemption of Vouchers should be submitted in writing to: ul. Śrutowa 17/1, 50-256 Wrocław, or by email to: [email protected]. Complaints will be resolved within 14 days of receipt of the Complaint.
12. In cases not covered by these Terms, decisions will be made by the Service Provider, or such matters will be governed by the Civil Code.
13. These Terms constitute an integral part of Voucher purchases and an integral part of the Terms of Service.
14. The Purchaser and the Recipient are required to read the content of these Terms as well as the content of the Terms of Service. All Terms are available at the premises' reception and are also available for review upon the client's request at any time.
1. The Client has the right to file a complaint regarding a Service within 14 days of its completion.
2. The Client should file the complaint in person at the Service Provider's premises using the complaint form.
3. The complaint must include the Client's personal details enabling their identification and contact, a description of the reason for the complaint, and the scope of the demands.
4. Photographic and/or video documentation will be taken regarding the reason for the complaint.
5. In every case, a condition for the complaint to be considered is the Client's personal appearance at the Service Provider's premises at ul. Śrutowa 14/LU1, 50-256 Wrocław. Complaints submitted by phone, email, text message, or social media will not be considered.
6. The Service Provider will resolve the complaint within 14 days of its receipt and will inform the Client in writing or by email at the contact details provided.
7. After the complaint is resolved, the Client is required to sign the complaint resolution report.
1. Every Client has the right to review the Terms, the price list, and any certificates that the Service Provider cites regarding their own experience.
2. The current Terms are available on the website www.pierceofcake.pl, as well as in person at the studio and shop located at ul. Śrutowa 17/1 and ul. Śrutowa 14.
3. Clients are liable without limitation, in accordance with Article 415 of the Civil Code, for any damage to the premises' equipment caused by the Client. For damage caused by minors, their legal representatives are liable.
4. The Service Provider is not liable for any items left in outerwear or on the premises outside of designated storage areas, in particular valuables, bags, backpacks, and purses, which the Client should keep with them.
5. Smoking and the use of tobacco and nicotine products, including electronic cigarettes, are completely prohibited throughout the entire premises, as is the complete prohibition of consuming alcoholic beverages and other stimulants or intoxicating substances.
6. Use of a phone by the Client is prohibited during the performance of the Service, except in emergency situations.
7. Bringing animals onto the premises is prohibited.
8. Bringing bicycles or scooters onto the premises is prohibited.
9. Any disputes arising from the Services provided should first be resolved amicably. If no agreement is reached, disputes will be settled by the competent court of general jurisdiction.
10. If any provision of these Terms is deemed invalid, non-compliant with the law, or unenforceable, it will be excluded from these Terms, which will otherwise continue to apply to the fullest extent permitted by law.
§ 14 Processing of Clients' Personal Data
By booking an appointment with the Service Provider, the client consents to the processing of their personal data for the purposes described below in this section.

Clients' personal data obtained in connection with the use of the Service Provider's services will be processed for the following purposes: communication with the client (receiving information regarding scheduled appointments via mobile telephony and email) and to perform the service.
The legal basis for processing Clients' data will be: consent given, necessity to perform the contract or to take action at the Client's request before concluding the contract, necessity to fulfill a legal obligation incumbent on the controller, necessity for purposes arising from legitimate interests pursued by the controller, e.g., such as responding to Clients' letters and requests.
Clients' data may be transferred to the following entities: processors (data-processing entities) in connection with actions commissioned by the Service Provider, entities authorized under legal provisions, supervisory and control bodies, enforcement authorities, courier companies delivering shipments to Clients.
Clients' data will be transferred to a third country (e.g., the USA) in connection with activities conducted on Facebook (clients contacting via the Service Provider's Facebook page or Instagram). The retention period for Clients' personal data depends on the purpose for which the data is processed. The retention period is calculated based on the following criteria: legal provisions that may require the Service Provider to process data for a specified period (e.g., invoice data is retained for 5 years from the end of the last fiscal year), the period necessary to defend the Service Provider's interests, and the period for which consent was given.
Furthermore, we inform Clients that they have the right to: request access to their personal data, rectify their data, request completion of incomplete personal data, including by providing an additional statement, delete their data or restrict its processing, object to further processing of their personal data, and transfer their personal data. However, in exceptional situations, data cannot be deleted immediately. These are:
• data necessary for the performance of the service and any applicable complaint period,
• data for which there are legal grounds to continue processing despite the above,
• data processed in accordance with other legal provisions.
Clients have the right to withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
In case of doubts regarding the correctness of personal data processing by the Service Provider, Clients have the right to lodge a complaint with the supervisory authority. All correspondence regarding matters related to the processing of personal data should be addressed to the Data Controller with the subject "Personal Data" at the email address: [email protected].
The Client's personal data is processed in accordance with the above content and for the purposes indicated in the above information clause, which the Client also reviews during their first visit.
§ 15 Information Clause – Video Monitoring
In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Official Journal of the EU L 119 of 4.5.2016) – hereinafter GDPR, we inform that:
1. The Data Controller of your personal data obtained from video monitoring is Pierce of Cake Magdalena Młodzianko, who can be contacted at the correspondence address: ul. Śrutowa 17/1, 50-256 Wrocław, or via email at: [email protected].
2. The premises subject to video monitoring is located at: ul. Śrutowa 14/LU1, 50-256 Wrocław.
3. The area covered by video monitoring is understood to mean: reception, waiting room.
4. All data recorded by the video monitoring cameras is stored and available for a maximum period of up to 85 days. The retention period depends on the number of events and the storage capacity of the recording device's disk. Once the disk space runs out, data is automatically overwritten. Only images (without sound) are recorded and stored on the media.
5. For evidentiary purposes, recordings of events registered by the video monitoring system are secured, in particular those which threaten public safety and order, and destruction and theft of property: at the request of third parties; at the request of authorities conducting proceedings; at the request of the premises' owner.
6. Any secured recordings of events registered by video monitoring may be made available upon request. Video monitoring data is made available only to authorities conducting proceedings related to the recorded event, e.g., police, the prosecutor's office, or courts, which act pursuant to separate regulations.
7. Your personal data will be processed for the purpose of ensuring public safety and order and protecting persons and property, based on Article 6(1)(e) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (GDPR), and based on Article 222 §1 of the Act of 26 June 1974 – the Labor Code.
8. Your personal data may be transferred to entities that process personal data on behalf of the Controller, pursuant to a concluded data processing entrustment agreement.
9. Your personal data will not be transferred to third countries (outside the European Economic Area, comprising the European Union member states as well as Iceland, Norway, and Liechtenstein).
10. No automated decisions (decisions without meaningful human involvement) will be made regarding you, and your personal data will not be subject to profiling.
11. You have the right to lodge a complaint with the supervisory authority — the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych) — if the processing of your personal data violates data protection regulations.
